Immigrants in Maryland and Virginia are being summoned at the last minute to immigration hearings held in buildings with no official court status — and in at least two cases, they received no notice at all. Federal regulations, including a policy manual cited by attorneys, set minimum notice requirements before a new hearing date can be considered legally valid. --- THE FACTS --- Immigrants originally scheduled for hearings at the Hyattsville and Baltimore courts in Maryland, and the Sterling court in Virginia, were rescheduled to two different buildings: one in Washington, D.C., and one in Falls Church, Virginia. Neither location functions as an in-person immigration court. One source familiar with the project, who was not authorized to speak publicly, said the D.C. building is listed as occupied by the Federal Emergency Management Agency, with no listed affiliation to the Justice Department. In at least two cases identified by NPR, immigrants were given no notification of the change. At one hearing attended by attorney Kel White, the judge and prosecutor appeared remotely while the immigrant appeared in person at the undisclosed location. --- THE POSITIONS --- White, an officer of the D.C. chapter of the American Immigration Lawyers Association with more than 15 years of practice, described what she witnessed as the most unusual thing she has ever seen in her career.
