Prosecutors to charge alleged dissident leaders in absentia in Uribe case

Prosecutors will publish summonses to charge alleged Segunda Marquetalia leaders in absentia over the June 7, 2025 murder of senator Miguel Uribe Turbay in…

--- The context --- Miguel Uribe Turbay was a Centro Democrático senator and presidential hopeful when he was attacked on June 7, 2025, in the Modelia neighborhood of western Bogotá. The attack was carried out by a minor, and his wounds led to his death weeks later. Investigators attribute the order for the crime to the dissident group known as Segunda Marquetalia. --- The facts --- Colombia's Attorney General's Office is moving toward charging several members of that organization in absentia. More than a year after the attack, the alleged intellectual authors have not been charged because authorities have been unable to serve them with a judicial notification, a prior requirement for any indictment. The whereabouts of several named leaders remain unknown, and their fugitive status has blocked the procedure through ordinary channels. Prosecutors will publish summonses calling them to a hearing. If they do not appear, the office will seek to have them declared absent persons so the proceeding can continue under that legal figure, according to information published by a Colombian magazine. The file names Luciano Marín Arango, alias Iván Márquez; José Manuel Sierra Sabogal, alias Zarco Aldinever; Kendry Téllez Álvarez, alias Yako; Gener García Molina, alias Jhon 40; Jhon Jairo Bedoya, alias Rumba; Alberto Cruzlobo, alias Enrique Marulanda, and Diógenes Medina Hernández, alias Gonzalo, all of them alleged offenders named by the investigation. --- The positions --- Prosecutors are also evaluating whether to request that the murder be considered imprescriptible, a designation that would prevent time from extinguishing the possibility of investigating and trying the case. That assessment would weigh the impact of the killing, since the victim was a senator who aspired to the Presidency. A charge in absentia would let the investigation continue without the physical appearance of the accused. --- What remains unknown --- A new complaint known to prosecutors and to the victim's family holds that García Molina allegedly financed and coordinated the murder with a total fund of $5.000.000.000. The information comes from a person linked to that group who seeks judicial benefits and the rewards offered for García Molina and Iván Márquez. According to that account, the money reached the camps through alias el Viejo, captured on October 27, 2025, in the Brisas del Güéjar hamlet, in Puerto Lleras, Meta. The complaint also mentions a meeting in Venezuela and three further meetings at a García Molina camp in Carurú. --- Unanswered questions --- Will any of the named men appear once the summonses are published, or will all of them be declared absent persons? Will the courts accept the request to treat the case as imprescriptible? What weight will the new leads on the planning and financing of the attack carry at the hearing? How will due process be guaranteed for defendants who are not present? --- EPM analysis --- The absent-person figure exists so that flight does not become a veto over justice. For the victim's memory and his family, seeing the process advance even without the accused is a sign that the case will not be shelved. Trying defendants in absentia demands, however, reinforced guarantees: the legitimacy of any future decision will depend on every procedural requirement having been respected. 📌 EPM Take: In EPM's view, moving toward charges in absentia is a necessary step so that the murder of a senator and presidential hopeful does not remain trapped in a notification procedure that the named men themselves frustrate by fleeing. Justice must advance without surrendering due process, because only an impeccable procedure honors the victim's memory and sustains the credibility of the outcome, whatever that outcome may eventually be within the Colombian judicial system.
