Saul Kattan faces complaint over Bio-Nube and Big Data projects in Colombia

Saul Kattan, former presidential adviser and former acting manager of Internexa, was reported to the Attorney General's Office over alleged irregularities in…

--- The context --- Colombia has debated how to build public digital infrastructure without repeating the contracting failures that have affected other areas of the State. Bio-Nube and Big Data for the Colombian State belong to that debate: two technology initiatives promoted through Internexa, a subsidiary of ISA, involving Saul Kattan Cohen, who served as senior presidential adviser for Digital Transformation during the Government of Gustavo Petro and later worked as acting manager and member of the board of directors of that subsidiary. That trajectory links direct advice to the president on cybersecurity, data, artificial intelligence and connectivity with later corporate decisions, and is the background to the case now before the Attorney General's Office and the Comptroller's Office. --- The facts --- Internexa's attorney filed a criminal complaint on August 4, 2026, for the alleged offences of disloyal administration, entering into contracts without meeting legal requirements and improper interest in entering into contracts. On October 16, the company delivered information to Comptroller General Jorge Laverde so that possible losses to public assets and any fiscal responsibilities could be examined. The allegations rest on a forensic audit ordered by ISA. Bio-Nube was an initiative valued at approximately 630,000 million pesos to develop technology infrastructure with public entities and private companies. The Ministry of Science, Technology and Innovation, Ecopetrol and Central de Inversiones S. A. took part, along with Huawei as supplier of equipment for data centers. The audit questioned how the project was structured and pointed to possible breaches of internal controls and corporate approval procedures. The project was never carried out with public resources and was halted after the alerts about its structuring. In Big Data for the Colombian State disbursements were made, and their origin, authorization and possible recovery are reviewed by Internexa. The board of directors of ISA approved on August 28, 2026, a recommendation to terminate the project early, and in early September it was agreed not to carry it out and not to ratify the decisions adopted during Kattan's administration. That difference lies at the center of the fiscal review. --- The positions --- The audit questioned administrative decisions, possible conflicts of interest and procedures used to promote the projects, as well as internal changes that would have affected decision controls and corporate governance. It also examined a possible conflict of interest from his earlier functions at the Presidency, and mentioned Jorge Carrillo, former president of ISA, for decisions on Kattan's appointment as manager. Kattan rejected the accusations and said he acted transparently and in accordance with the law. He expressed surprise, denied a conflict of interest and explained that he had committed to reporting any situation of that kind so he could be removed from the decision. He denied using privileged information, maintained that the Big Data disbursements were made after his departure and said he held a legal opinion under which he did not need board authorization to take part in the projects. --- What remains unknown --- There is still no decision from the Attorney General's Office on the alleged offences and no ruling from the Comptroller's Office on losses to public assets or fiscal responsibility. The amount of the Big Data disbursements is also unknown, as is whether they can be recovered. --- Unanswered questions --- Why did decisions of this scale advance without prior approval by the board of directors being fully established? Which internal controls failed at Internexa and ISA for two strategic initiatives to advance amid questions about structuring and corporate governance? How much exactly was disbursed in Big Data, who authorized each payment and what part can be recovered to protect public assets? --- EPM analysis --- This case tests a basic promise of the State's digital transformation: that public technology will be built with controls as rigorous as its ambition. 📌 EPM Take: In EPM's view, this case requires looking beyond one name and demanding an account of the whole system that allowed Bio-Nube and Big Data to advance amid alerts, approval doubts and possible conflicts of interest. Protecting public assets requires the Attorney General's Office and the Comptroller's Office to establish with evidence what happened, what it cost and who answered for each decision. At the same time, Kattan has the right to defend himself and to have his version tested in the case files. Without full transparency on the audit and the disbursements, the State's digital transformation will keep carrying a suspicion that harms citizen trust.
