Government ends 36 years of Fiduprevisora contract at FOMAG

--- The context --- The National Fund for Teachers' Social Benefits, known as FOMAG, is the mechanism through which the State answers for the health and social benefits of Colombia's teachers. Its administration and operation remained for decades in the hands of Fiduprevisora, under an uninterrupted scheme. --- The facts --- The Ministry of Education, backed by Finance, Labor and spokespersons for Fecode, confirmed this Friday, October 30, that the contract with Fiduprevisora for the administration and operation of the teachers' fund will not be renewed. It is Commercial Trust Contract No. 083 of 1990, signed between the National Ministry of Education and Fiduprevisora S. A., whose formal expiration falls this October 31, 2026. The notification was formalized in an extraordinary session of the Board of Directors of FOMAG. With it, the Government puts an end to a scheme that governed for 36 years, giving way to a new stage starting November 1. The decision responds, as presented, to an accumulation of operational and administrative failures that overwhelmed the teachers' health system. The Health Superintendency revealed that FOMAG accumulates pending accounts payable exceeding $2.4 trillion for medical services, supplies and medicines, and that 51%, around $1.24 trillion, shows, as of June 30, arrears of more than 180 days. In addition, of 3,934 registered providers, the fund reported in October only a single formally legalized contract, and the Minister of Finance, Miguel Gómez Martínez, warned in a political control debate in the Chamber of Representatives that FOMAG was left with a deficit of $2.7 trillion that must be covered. --- The positions --- The Minister of Education, Ilva Myriam Hoyos, held in reported speech that the conditions that contributed to the crisis cannot be prolonged nor their consequences normalized, and that FOMAG is the mechanism with which the State must answer for the rights of those who educate Colombia. The Minister of Labor, Natalia López Fuentes, reiterated in reported speech that teachers cannot assume the consequences of administrative failures. --- What remains unknown --- From November 1, 2026, a one-year transition plan will govern, extendable for twelve additional months, for the deep administrative and operational adjustments. The detail of that stage is still missing, as is the plan of activities the Ministry demanded Fiduprevisora deliver immediately to ensure uninterrupted functioning during the handover. --- Unanswered questions --- How will the deficit of $2.7 trillion be covered? Within what timeframe will the accounts with arrears over 180 days be brought up to date? When will the care network have more legalized contracts than the single one reported in October? Which entity will assume the administration of the fund once the transition ends? --- EPM analysis --- The authorities guaranteed that medical service will not suffer interruptions. Consultations and the continuity of treatments under way will be maintained without restarting processes, as will the continuous supply of medicines and inputs, and the regular payment of severance, pensions and other benefits will continue in accordance with the applicable legal procedures and terms. 📌 EPM Take: In EPM's view, closing a 36-year contract will only make sense if the transition protects from day one what is essential, medical care without interruptions and the regular payment of severance and pensions. The known figures, with accounts payable exceeding $2.4 trillion and a deficit of $2.7 trillion, require the one-year plan, extendable for twelve additional months, to be executed with public and verifiable goals, so that the administrative change translates into a real improvement for teachers.
