The Dana Leonte case reaches a jury trial in Malaga

A jury will try the defendant from 3 November over the disappearance and death of Dana Leonte in 2019 in Arenas.

--- The context --- After Dana Leonte disappeared in 2019 in Arenas, in Malaga, the case is reaching trial. A jury will try the defendant, who was her partner and remains on provisional release, starting this Tuesday, 3 November. The hearing will run for at least nine sessions over two weeks, until Friday 13. --- The facts --- The trial will begin on Tuesday with the selection of the jury and the defendant's statement. Afterwards 15 witnesses will testify, along with 21 Civil Guard officers, forensic doctors and experts, among others. The events being tried took place on 12 June 2019 at the family home in Arenas, after a mobile phone conversation in which she told him she did not wish to be with him. According to the prosecution, that night the defendant allegedly struck Dana Leonte hard on the head with a wooden stick. The accusations say she was left unconscious or badly injured and that the defendant allegedly moved the body to the trunk of a car, dismembered it elsewhere and scattered and buried the remains. They also say he allegedly cleaned the home and accessed the victim's phone. After numerous searches in Axarquia, the first remains were found on 21 June and others in October and in November. The defendant was arrested in September. --- The positions --- The prosecution seeks 17 years for homicide and another offence against moral integrity, arguing that he allegedly habitually exercised physical or psychological violence against his partner. The private accusation, on behalf of the brother, accuses him of murder and seeks 20 years, arguing that he allegedly intended to take her life and then dismembered and hid her remains. Both consider that the aggravating circumstances of gender discrimination and kinship apply. The defence denies the events and seeks acquittal. According to the accusations, the victim had previously reported him over gender violence, although he was acquitted. They seek restraining measures for the daughter, cared for by the brother, withdrawal of parental authority, and 300,000 euros for the minor and 100,000 euros for the brother. --- What remains unknown --- There is still no verdict. The jury will have to weigh testimony and forensic reports before ruling on what the accusations attribute to the defendant. --- Unanswered questions --- What will the jury decide after hearing witnesses, Civil Guard officers and forensic doctors over nine sessions? Will the prosecution's homicide classification prevail, or the private accusation's murder classification? What weight will the jury give to the fact that the defendant denies the events and was acquitted over an earlier report? --- EPM analysis --- The heart of this trial is not only what, according to the accusations, happened on 12 June 2019, but its legal classification. Between homicide and murder lie intention and circumstances, explaining the gap between the two requests. The daughter must also be protected. 📌 EPM Take: In EPM's view, this trial should be read with a double and calm demand: full respect for Dana Leonte and for her family, who have waited for answers since 2019, and an intact presumption of innocence for the defendant until the jury delivers its verdict. The distance between 17 years for homicide and 20 years for murder shows that what will be decisive is the evidence heard in court, not the prior narrative. Only the verdict, after nine sessions of testimony and expert reports, can turn opposing arguments into judicially declared facts.
