Supreme Court Upholds 28-Year Sentence Against Santiago Uribe

The Labor Cassation Chamber confirmed the denial of the tutela filed by the defense of Santiago Uribe Vélez and left firm the 28-year sentence issued by the…

--- The context --- Santiago Uribe Vélez, brother of former President Álvaro Uribe, faces judicial proceedings related to the formation of the group known as "Los 12 Apóstoles". The case moved through several instances and chambers of the Supreme Court of Justice, which examined his defense appeals against the sentence for aggravated homicide and conspiracy to commit crimes. --- The facts --- The proceedings began with an acquittal by a first instance court. The Prosecutor's Office appealed that decision and the process ended with a sentence of 28 years in prison for aggravated homicide and conspiracy to commit crimes, a determination that reached the Criminal Cassation Chamber of the Supreme Court of Justice. The Criminal Chamber upheld the sentence on June 3 after rejecting as inadmissible the extraordinary cassation appeal by the defense. The Civil Chamber denied on October 7 the tutela seeking revocation of the sentence. Now, the Labor Cassation Chamber, with a presentation by Justice Omar Ángel Mejía Amador, confirmed that denial and left it firm. --- The positions --- The defense alleged in the tutela that due process, equality and the administration of justice had been violated. The Labor Chamber held that the Criminal Chamber is the closing body for the special challenge, that there is no third instance and no further cassation against decisions of the same Court, and that the tutela does not reopen debates on judges' criteria in rulings grounded in the constitutional and legal framework. --- What remains unknown --- The tutela was transferred to the Constitutional Court for its eventual review. That eventual examination is the only step mentioned after the Labor Chamber confirmation, and its scope will depend on what that corporation decides on the transferred file. --- Unanswered questions --- What will the Constitutional Court decide when examining the tutela transferred for its eventual review? Will it maintain the criterion of the Civil Chamber confirmed by the Labor Chamber? Will the 28-year sentence thus remain with no further examination available? --- EPM analysis --- The course of the case shows an orderly sequence of successive decisions: an initial acquittal, an appeal by the Prosecutor's Office, a subsequent sentence and rulings by three Supreme Court chambers. The latest decision delimited the scope of the tutela against rulings that already passed through the closing body, a central point to understand the firmness reached. 📌 EPM Take: In EPM's view, the Labor Cassation Chamber decision closes a procedural stage defined by the Supreme Court structure itself, by confirming that the Criminal Cassation Chamber acts as the closing body and that the tutela does not constitute an additional instance to review the judges' criteria. The transfer to the Constitutional Court for its eventual review keeps only that examination open, without altering the firmness of the 28-year sentence that was confirmed in this decision.
